Service Agreement

1. Introduction
This Service Agreement ("Agreement") is entered into by and between Auxilium ("Company") and the customer ("Customer") who purchases services from the Company. By purchasing our services, the Customer agrees to the following terms and conditions.
2. Services Provided
The Company agrees to provide comprehensive college planning services, which may include personalized guidance on college selection, financial aid and scholarship strategies, essay writing support, career planning, and self-guided online training courses. Customers can choose to work directly with our team or purchase access to our online courses, which offer a structured, self-paced learning experience. The specific services provided will be outlined in the purchase confirmation and/or service description provided to the Customer.
3. Fees and Payment
The Customer agrees to pay the fees for the services selected at the time of purchase. Payment is due at the time of service selection unless otherwise agreed upon in writing by the Company. The Company reserves the right to change its fees at any time, with any changes taking effect for new purchases only.
4. Refund Policy
If the Customer is not satisfied with the services provided, they may request a refund. Refund requests must be made in writing and submitted to [email protected] within three (3) days of purchase. The Company will review the request and may issue a refund.
5. Completion Verification and Chargeback Policy
To ensure that the Customer has made a genuine effort to utilize the services provided, the Company will verify completion of coursework and adherence to recommendations as follows:
- The Customer must complete all coursework and follow all recommendations provided by the Company.
- For private clients, the Company requires timely submission of necessary documents such as, but not limited to, tax returns and other financial data.
- Students receiving assistance must complete tasks such as their essays and other assigned work in a timely manner.
- The Company will track and verify the Customer’s progress through its system.
- If a refund request is made, the Company will check its system to ensure that the coursework and recommendations have been fully completed by the Customer.
- The Company reserves the right to fight any chargebacks or refund requests if it determines that the Customer has not completed the coursework or followed the recommendations. Proof of completion will be used in any disputes related to chargebacks.
6. Limitation of Liability
In no event shall the Company be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of the services provided, even if the Company has been advised of the possibility of such damages.
7. Indemnification
The Customer agrees to indemnify, defend, and hold harmless the Company and its affiliates, partners, employees, and licensors from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the Customer's breach of this Agreement or violation of any law or the rights of a third party.
8. Termination
The Company reserves the right to terminate this Agreement and the Customer’s access to services without prior notice or liability, for any reason, including breach of this Agreement. The Customer may terminate this Agreement at any time by providing written notice to the Company.
9. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California and the County of Los Angeles, without regard to its conflict of law principles.
10. Entire Agreement
This Agreement constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, and representations, whether written or oral, regarding such subject matter.
